Terms of use

Please read the following Terms of Service ("the Terms") carefully prior to using the Kyushu Gururi service and all Kyushu Gururi related services ("the Services") including Kyushu Gururi app ("the App") provided by Kumamoto Prefecture and Kumamoto Prefecture Tourism Federation ("the Prefecture").
The rights to access and to utilize the App are solely conditioned on the acceptance of and compliance with the Terms by you ("the User"). The Terms apply to all users and visitors who may access or utilize the App and the Services. If or when the User disagrees with any part of the Terms, the User is to suspend and to terminate all use of and access to the App and the Services immediately.
This concludes the statement of general Terms of Service. Individual Agreements for the App and the Services are listed under "Individual Agreements" section of the page.

(1) Definition

Following defines all terms and phrases applicable herein. The App and the Services constitute the Kyushu Gururi service, its related mobile device application, and all its contents provided by the Prefecture to the User. All rights reserved. The Prefecture is the sole proprietor of all copyrights, trademarks, patents, and intellectual property rights of the App and the Service.

(2) Terms of Service

By accessing and utilizing the Services, the User hereby acknowledges and agrees to all of the Terms stated herein. Whereas, Kumamoto Prefecture ("the Prefecture") hereby grants the User a non-exclusive license to access and to utilize the App and the Services on his/her personal computing device(s) except for the uses infringing any and all Terms. Whereas, the Prefecture preserves the rights to terminate the said non-exclusive license granted to the User at any given moment. The User shall only access and utilize the App and the Services strictly under these guidelines and may not do so for intended purposes to engage in illegal or criminal activity or any other conduct against the public standards of decency.

(3) Copyright, Trademarks, Patents and Intellectual Property Rights

All rights reserved. The App and the Services are protected intellectual properties of the Prefecture in accordance with international copyright treaties. Unauthorized use of the copyrighted materials is strictly prohibited.
All materials including copied items from the App and/or the Services legally hereby belong to the Prefecture; thus, the User is only permitted to access and to utilize each and every part of the App and/or the Services strictly on the grounds of these conditions of the Terms granted by the Prefecture.
Any form of duplication, decompilation, reverse engineering, editing, or altering of the App or the Services as a whole or in part is an infringement of intellectual property rights. The User, thus, is not entitled to transfer the rights granted to him/her to access and to utilize the App and/or the Services to a third-party for the purpose of replicating, reproducing a duplicate copy, or a derivative work of the App or the Services of any sort. The User hereby acknowledges and agrees that any and all forms of copyright, trademarks, patents, and intellectual property rights to the App and the Services belong to the Prefecture, and not the User. Furthermore, the User hereby acknowledges and agrees to that any and all rights not forenamed under the Terms belong to the Prefecture, and not the User. All rights reserved for all materials used on the App and the Services not forenamed under the Terms regarding copyrights, trademarks, or patents as well.

(4) General Liability Release of Claims

This is an agreement to release and to waive the Prefecture from any and all liabilities regarding injuries that may occur while accessing, operating, browsing, or utilizing the App and/or the Services by the User.
Kumamoto Prefecture ("the Prefecture") is not legally responsible or liable for any and all injuries and accidents that may occur while accessing, operating, browsing, or utilizing the App and/or the Services by the User. Furthermore, the Prefecture is not legally responsible or liable for any and all injuries and accidents that may occur due to failure to access, operate, browse, or utilize the App and/or the Services by the User.
Furthermore, the Prefecture is not legally responsible or liable for a failure to properly connect, access, or navigate the App and/or the Services.

(5) Effective Date(s)

The Terms are effective until the User so decides to terminate his/her use of the App and/or the Services; however, should the User infringe any aforementioned conditions of the Terms, the Prefecture preserves the rights to refuse and to terminate the use of the App and/or the Services without a prior notice given to the User at any given moment.
This is an agreement acknowledging that the Prefecture preserves the rights to refuse and to terminate the user of the App and/or the Services without a prior notice given to the User at any given moment. Should this take place, the User is to follow the guidelines provided under the Terms accordingly.
Each and every disclosed material on the App and the Services including files and libraries is subject to a sudden removal or termination without a prior notice given to the User. Should such an event occur, the User is to suspend his/her use and access to the App and/or the Services and proceed to delete any and all related files and materials obtained from the App and/or the Services on their device(s).

(6) General Guideline

The conditions of the Terms are to be interpreted in accordance with the Japanese national law. Should any dispute between the User and the Prefecture arises regarding the Terms, the case is to be handled at the Kumamoto District Court located at the Kumamoto Prefectural Office complex as it holds jurisdiction over each and every lawsuit or legal claim regarding the Terms.
The User hereby acknowledges that he/she has thoroughly read and agrees to all of the conditions of the Terms. Furthermore, the User acknowledges and agrees that he/she is to be held legally responsible for making necessary monetary compensations or reparative amends to the Prefecture for punitive damages in the event that the User violates or infringes the Terms. In such cases, the User will also be placed under the subjugation of the Prefecture for further notice.

Kyushu Gururi: Terms of Service

(1) Using our Services and the App

Unauthorized duplication or replication of our services ("the Services") or mobile application ("the App"), including the libraries, documents, and sample files, is strictly prohibited. Decrypting or unauthorized distribution to a third party of the files is also prohibited. The files, related libraries, documents and sample files are to be accessed and utilized by you ("the User") only within the context of the Kyushu Gururi App and/or the Services as a whole. Partial use of such contents apart from the context of the App and/or the Services is strictly prohibited.
Should the User violate or infringe the Terms, the Prefecture can and may pursue a further legal action against the User. Furthermore, the Prefecture can and may hold the User legally responsible for making necessary monetary compensations or reparative amends to the Prefecture for punitive damages in such cases.
In addition, should the User cause functional damages to the Kyushu Gururi App by wrongfully operating or altering the App and/or the Services, the Prefecture can and may pursue a separate legal action from the aforementioned scenario against the User for punitive damages.

(2) User Data on System Server

All User data on the system server including the User’s files, scripts, databases, pages and other related materials belong to the Prefecture; however, this excludes the User’s personal information as well as any data about the User which the User declines to be stored on or be removed from the system server.

(3) Security

The User hereby acknowledges and agrees that it is the User’s sole responsibility to handle all security issues with his/her device(s) used to access or to utilize the App and/or the Services and that it is the User’s sole responsibility should an accident occur to his/her device(s) or to a third party from accessing or utilizing the App and/or the Services. The User hereby understands and declares that the Prefecture cannot be and will not be legally responsible by the User for any and all possible accidents or damages caused from the User accessing or utilizing the App and/or the Services.
All rights reserved. All copyrights, trademarks, patents, and intellectual property rights reserved for the rightful owner(s) for each and every material appearing on the App and/or the Services with the rightful owner(s) - including but not limited to businesses, establishments, institutions, names, systems, services, products, merchandise, titles, landmarks, symbols, and designs.

Privacy Policy

Article 1: Definition

This user privacy policy for the mobile device application ("the Policy") refers to the mobile device application Kyushu Gururi App ("the App") and its related services ("the Services") provided by Kumamoto Prefecture ("the Prefecture") to you ("the User").
The User must read thoroughly and agree to the Policy prior to accessing or utilizing the App. The Policy herein addresses matters regarding handling of personal information of the User by the Prefecture.

Article 2: Items of Personal Information, Purpose, and Method

Following items of personal information will be obtained automatically via the App solely based of the purpose stated herein. The obtained items of personal information will not be shared with a third party.

Items of Personal Information: User location via the Global Positioning System (“GPS”)
Purpose: For purpose of providing the User with information for tourist destinations
Method: Automatic

Article 3: Agreement

Section 1:
Please read thoroughly and confirm each and every item of the Policy prior to accessing or utilizing the App and/or the Services. The Policy is publically viewable under the links listed in Article 7. The User hereby acknowledges and agrees that the Policy has been made available to him/her. The User is obligated to read thoroughly and confirm/disconfirm the Policy prior to installing the App on his/her mobile device(s).
Section 2:
The User’s personal information must be obtained via GPS in order to activate the location finding functions provided on the App and/or the Service. The User must give consent to it prior to utilizing such functions. Failing to do so will result in unable to utilize the functions as well as, in some cases, the App itself.

Article 4: Transmitting Information

The items of personal information stated under Article 2 will be transmitted to the Prefecture’s designated server system. The said items will be handled strictly and solely for the purpose aforementioned in Article 2.

Article 5: How to Use

The User can edit, delete, or terminate any and all items of personal information obtained by the App. The User can also cancel the use of the App and/or the Services at his/her discretion.
To prevent the App from obtaining the current location, the User can turn off the terminal GPS system installed on his/her device(s). The User can view and access his/her general location as well as the App navigation system based on the rough location provided by the wireless service provider if/when the terminal GPS system is turned off.

Article 6: User Termination and Personal Information

The User can terminate the use of the App by uninstalling the App on his/her mobile device(s). Upon the termination, the User’s personal information obtained via terminal GPS system will be deleted. It will also be deleted thoroughly from the App’s server system during its scheduled maintenance period.

Article 8: Public Information and Distribution

With the exceptions listed below, the Prefecture will not share or display the User’s personal information on database without the consent of the User.
1. Cases when legally required by the government or governing authority.
2. Cases when a human life or the well being of an individual is at risk.
3. Cases when it is deemed necessary and that it will not hinder or violate the personal rights of the User.

Article 10: Update(s)

The Policy may be updated without notice.
Section 1:
As the App may experience updates, items of personal information necessary from the User may be added and/or edited. In such cases, a notice will be sent to the User prior to downloading of the updated version of the App begins. In addition, a further notice will be sent to the User as a confirmation for particularly pertinent items added and/or edited either prior to or proceeding the installation of the updated version of the App.
Section 2:
In the event of the items of personal information from the User being added and/or edited, the purpose of obtaining such personal information be altered and/or updated, or the said information be shared with a third party such as the governing authorities, the User will be notified via the App. For particularly pertinent items and cases, a separate notice will be sent to the User to notify of it as well.
